GOVERNMENTAL TORT LIABILITY
We pride ourselves on our representation of such governmental entities as cities, counties, special districts, schools, state agencies, elected officials and municipal employees. With the erosion of individual responsibility, sovereign immunity is no longer the rule and governmental entities are increasingly called upon to account for all of society’s ills.
Since many of our attorneys have held careers in the public sector, we are particularly adept at understanding the special environment in which public entities operate. We are well versed in the procedural and substantive defenses afforded governmental defendants by the Federal Torts Claims Act, the California Torts Claim Act and on such related judicial doctrines as sovereign immunity, standing, exhaustion of remedies, and the government contractor doctrine.
Substantively, we have represented public entities in such specific actions as negligent performance of contracts, intentional tort, assault and battery, false arrest, constitutional torts, taking of property, employment and racial discrimination, dangerous conditions of public property, violation of ministerial obligations, failure to discharge mandatory duties, injuries caused by tortious conduct of independent contractors and inverse condemnation.
