EMPLOYMENT LAW
Employment Law. Employees are suing their current and former employers more frequently, with an estimated 450 employee lawsuits filed each day. Of the cases that are tried, 56 percent result in plaintiff’s verdicts – a success rate that is exceeded only by automobile accident lawsuits. The complicated plethora of recent federal and state legislation has created a work environment where an uninformed and unprotected employer is exposed to seemingly limitless liability. Employment lawyers must be able to read between the lines of the law to determine when to litigate and when to arbitrate and/or seek federal and other forms of preemption. We have kept apace of this fast developing and changing area of the law and have developed successful strategies to defend employers against lawsuits. Equally important, our attorneys work with employers to prevents such suits from being brought, and advise them of their rights and responsibilities.
Employment Law: Lawsuit Prevention. Given the overwhelming growth in litigation arising from work place conduct, Manning & Marder specializes in education employers to prevent lawsuits before they arise. Through review of on-site practices, policies and procedures, education, and other consulting measures, our attorneys have effectively reduced client exposure to civil litigation. Our attorneys consult with and instruct employers on a regular basis. In addition, our attorneys are approved by the State Bar of California to instruct other attorneys on labor and employment law issues.
Administrative Hearings: Pre-Lawsuit Investigation. Representing employers also includes dealing with the various regulatory agencies and administrative law hearings. Our attorneys have appeared before the United States Department of Labor, the California Department of Labor, the Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing, the Employment Development Department, and other tribunals.
